These Terms of Service (“Terms”) govern your use of Scrubswire (“the Service”), operated by ViralMomentum LLC, a Wyoming limited liability company (“Scrubswire,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts
You are responsible for maintaining the security of your account credentials and for any activity under your account. Notify us immediately at support@scrubswire.com if you believe your account has been compromised.
You agree to provide accurate information and to keep it current. You may not impersonate another person or misrepresent your affiliation with any organization.
3. User-submitted content
The Service allows users to submit articles, tips, letters, and other content (collectively, “User Content”). The following terms apply to all User Content.
License you grant us
By submitting User Content to Scrubswire, you grant Scrubswire a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in connection with the Service and Scrubswire’s other publications, in any media now known or later developed.
This license terminates when you remove the User Content, except to the extent the User Content has been incorporated into a published article (in which case the published version remains available under the license).
You retain ownership of your User Content.
Editorial review
All User Content submitted as an article is reviewed by a Scrubswire editor before publication. We may publish, edit, or decline any submission, in our sole discretion. Editorial decisions are final.
Your representations
When you submit User Content, you represent and warrant that:
- You own the rights to the content, or have permission to submit it.
- The content does not infringe any third party’s intellectual property, privacy, or publicity rights.
- The content does not contain defamatory statements, unlawful threats, or content that violates applicable law.
- Any factual claims are true to the best of your knowledge, and any quotations are accurate.
- The content is not a paid promotion or undisclosed advertisement.
You agree to indemnify Scrubswire for any third-party claim arising from User Content you submitted.
4. Prohibited conduct
You agree not to:
- Use the Service in violation of any law.
- Submit content that is unlawful, defamatory, harassing, threatening, hateful, sexually exploitative, or that infringes on the rights of others.
- Attempt to gain unauthorized access to any part of the Service, any account, or any system or network connected to the Service.
- Use automated tools to scrape, harvest, or otherwise extract data from the Service without our prior written permission.
- Interfere with the operation of the Service or any other user’s enjoyment of it.
- Misrepresent your identity, affiliation, or the source of any content you submit.
- Use the Service to send spam, phishing messages, or chain communications.
5. Intellectual property
The Service, including all editorial content produced by Scrubswire, is protected by copyright, trademark, and other laws. Except for User Content, all material on the Service is owned by ViralMomentum LLC or our licensors.
You may quote brief passages of Scrubswire articles for purposes of commentary, criticism, news reporting, teaching, scholarship, or research, with attribution to Scrubswire and a link to the article when feasible. Wholesale reproduction of articles, including by AI training scrapers, is not permitted without our prior written consent.
6. DMCA
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c) to dmca@scrubswire.com, including:
- A description of the copyrighted work claimed to be infringed.
- The URL of the allegedly infringing material.
- Your contact information.
- A statement of good-faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act.
- Your physical or electronic signature.
We will respond to valid notices and may terminate the accounts of repeat infringers.
7. Termination
We may suspend or terminate your account at any time, with or without cause, including for violation of these Terms. You may terminate your account at any time by emailing support@scrubswire.com.
The provisions of these Terms that by their nature should survive termination — including the licenses granted in Section 3, intellectual property rights, disclaimers, indemnification, and limitations of liability — will survive.
8. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE.” Scrubswire and its affiliates make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Scrubswire is a journalism platform. Nothing on the Service constitutes medical, legal, financial, or other professional advice. Do not act on information published on Scrubswire without consulting an appropriately licensed professional.
9. Limitation of liability
To the maximum extent permitted by law, in no event will Scrubswire, ViralMomentum LLC, or any of our officers, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service.
In no event will our aggregate liability for any claim arising out of these Terms or your use of the Service exceed the greater of: (a) the amount you paid Scrubswire in the 12 months before the claim, or (b) one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold Scrubswire harmless from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising out of: (a) User Content you submitted; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party right.
11. Governing law and dispute resolution
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Service will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction in those courts.
12. Changes
We may modify these Terms. If we make material changes we will notify account holders by email and post the updated version with a new “Last updated” date. Your continued use of the Service after the effective date of the change constitutes acceptance of the new Terms.
13. Miscellaneous
These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and Scrubswire regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver.
